ACKNOWLEDGEMENT OF RISK AND WAIVER OF LIABILITY - SPCA of Hancock County Fourth Annual Howl-O-Run 5K. Read this Acknowledgement of Risk and Waiver of Liability carefully and in its entirety. It is a binding legal document. Please acknowledge that you have read, understood, and agreed upon the following statement by checking the checkbox at the end of this statement. This statement must be read and acknowledged by all guardians of minor children. - If you are under the age of 18, this form must be signed by you as the participant AND by your parent or legal guardian. I know that participating in the Howl-O-Run 5K is a potentially hazardous activity and I should not enter and participate unless I am medically able and properly trained. I acknowledge and assume any and all risks associated with this event including, but not limited to, traffic on the course route, falls, contact with other participants, and the condition of the course, including, but not limited to, curbs, cars, uneven pavement, potholes, rocks, and objects on the course surface. Knowing and appreciating these risks and in consideration of your acceptance of my entry, I hereby for myself, my heirs, representatives or anyone else claiming on my behalf, covenant not to sue, and waive, release, and the SPCA of Hancock County, its volunteers, and sponsors, and anyone else acting for or on behalf of Howl-O-Run from any and all claims of liability for death, personal injury, or damage of any kind arising out of my participation in this run. This Acknowledgement of Risk and Waiver of Liability extends to all claims of every kind whatsoever. I also consent to emergency treatment in the event of injury or illness. I grant full permission to the SPCA of Hancock County and/or any person or entity authorized by it to use my name, age, finish place and finish time in the public domain. I further grant full permission for SPCA of Hancock County to use any photographs, recordings, or any other record of this event for any purpose. My electronic acknowledgement certifies that I have read the above waiver and I agree and accept all terms and conditions set forth herein.
*In regards to donations: Acceptance of any contribution, gift or grant is at the discretion of the SPCA of Hancock County, Maine. The SPCA of Hancock County, Maine will not accept any gift unless it can be used or expended consistently with the purpose and mission of the SPCA of Hancock County, Maine.
No irrevocable gift, whether outright or life-income in character, will be accepted if under any reasonable set of circumstances the gift would jeopardize the donor’s financial security.
The SPCA of Hancock County, Maine will refrain from providing advice about the tax or other treatment of gifts and will encourage donors to seek guidance from their own professional advisers to assist them in the process of making their donation.
The SPCA of Hancock County, Maine will accept donations of cash or publicly traded securities. Gifts of in-kind services will be accepted at the discretion of the SPCA of Hancock County, Maine.
Certain other gifts, real property, personal property, in-kind gifts, non-liquid securities, and contributions whose sources are not transparent or whose use is restricted in some manner, must be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose for SPCA of Hancock County, Maine.
The SPCA of Hancock County, Maine will provide acknowledgments to donors meeting tax requirements for property received by the charity as a gift. However, except for gifts of cash and publicly traded securities, no value shall be ascribed to any receipt or other form of substantiation of a gift received by SPCA of Hancock County, Maine.
The SPCA of Hancock County, Maine will respect the intent of the donor relating to gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, the SPCA of Hancock County, Maine will restrict information about the donor to only those staff members with a need to know.
The SPCA of Hancock County, Maine will not compensate, whether through commissions, finders' fees, or other means, any third party for directing a gift or a donor to the SPCA of Hancock County, Maine.
